Terms & Conditions

Just a few things before we start working together.

-COPYRIGHT
– ALL photographs and videos remain the intellectual property of the photographer.
– The client is granted a non-exclusive, non-transferable license to use the final edited images/videos for the agreed purpose (personal, commercial, or editorial).
– RAW or UNEDITED files will not be provided unless agreed in writing.
– The client may not alter, sell, or claim authorship of the images/videos without written consent.

USAGE RIGHTS
– Personal Clients (e.g., portraits, lifestyle, events): Images/videos may be used for personal printing, sharing on social media, and personal archives. Credit to the Photographer is appreciated.
– Commercial/Brand Clients (e.g., fashion, advertising, editorial): Usage rights must be agreed in writing and may require a separate licensing fee depending on scope (e.g., online, print, billboard, broadcast).
– The Photographer reserves the right to use any images/videos for portfolio, website, exhibitions, competitions, and social media unless the Client requests otherwise in writing before the session.

BOOKINGS & PAYMENT
– A [ 50% ] non-refundable deposit is required to secure a booking.
– The remaining balance is due [24HRS] before delivery of final files.
– Payment may be made via [bank transfer/ payment link].
– Bookings are not confirmed until the deposit has been received.

CANCELLATIONS AND RESCHEDULING
– Cancellations made by the Client within [ 5 DAYS ] of the scheduled shoot/final file delivery will result in the loss of the deposit.
– If the Photographer must cancel due to illness, emergency, or unforeseen circumstances, the Client will receive a full refund of any payments made, or the option to reschedule.

DELIVERABLES & TURNAROUNDS
– The Photographer will deliver the photos/videos within the originally discussed time frame.
– Delivery will be via [online gallery / download link.
– The Photographer is not responsible for delays caused by the Client (e.g., late selection of images, failure to provide necessary details).

MODEL RELEASE AND CONSENT
– By booking, the Client grants the Photographer permission to photograph/video them (or individuals they book on behalf of).
– A signed Model Release may be required for certain shoots (especially fashion/editorial) to allow images/videos to be used in portfolios and promotional material.
– The Client is responsible for ensuring all participants (including minors, with parental consent) agree to being photographed/filmed.

LIABILITY & LIMITATION
– While all reasonable care will be taken, the Photographer is not liable for circumstances beyond their control, including but not limited to equipment failure, weather, illness, or accidents.
– Liability is limited to the amount paid for services.
– The Photographer is not responsible for printing errors or issues with third-party labs.

PRIVACY AND DATA COLLECTION
– Personal information collected (name, email, phone number, address) will be used solely for communication and booking purposes.
– Images and videos may be stored securely for backup and portfolio purposes.

BY BOOKING WITH LITSAKPHOTOGRAPHY, THE CLIENT ACKNOWLEDGES THAT THEY HAVE READ, UNDERSTOOD AND AGREED TO THESE TERMS AND CONDITIONS.
